LocalLoop™ Subscriber, VIP Check-In, Draw Terms and Privacy Policy

1. About LocalLoop™

1.1 LocalLoop™ is operated by Najah Pty Ltd ABN 11 165 433 858 in Australia.

1.2 LocalLoop™ provides local community newsletters, subscriber communications, VIP check-in technology, loyalty-style visit tracking, partner store communications, sponsored newsletter placements, community sponsorship features and related local business promotions.

1.3 By subscribing to LocalLoop™, joining a LocalLoop VIP list, checking in at a participating store, entering a LocalLoop-run promotion, or otherwise participating in LocalLoop, you agree to these terms and conditions.

1.4 These terms apply to:

1.4.1 LocalLoop newsletter subscribers;

1.4.2 LocalLoop VIP members;

1.4.3 the LocalLoop Monthly Subscriber Draw;

1.4.4 LocalLoop in-store check-in technology;

1.4.5 LocalLoop referral or bonus-entry promotions, where offered by LocalLoop;

1.4.6 LocalLoop advertising and sponsored content;

1.4.7 LocalLoop privacy and data handling; and

1.4.8 LocalLoop communications sent through LocalLoop systems.

1.5 LocalLoop may update these terms from time to time. Continued subscription, participation or use of LocalLoop after an update means you accept the updated terms.

2. Parties and Responsibilities

2.1 In these terms, “LocalLoop,” “we,” “our” and “us” means Najah Pty Ltd trading as LocalLoop™.

2.2 “Participating store” means an independent business, retailer, grocer, supermarket, butcher, café, local business or other business that uses LocalLoop technology, communication channels, check-in tools or related services.

2.3 LocalLoop is responsible for LocalLoop-run promotions only.

2.4 The main LocalLoop-run promotion covered by these terms is the LocalLoop Monthly Subscriber Draw for the $100 Activ Visa Gift Card.

2.5 Participating stores are solely responsible for their own store-run promotions, including in-store prize draws, VIP check-in draws, customer giveaways, voucher promotions, loyalty promotions, referral promotions, prize fulfilment, eligibility decisions, winner verification, redraws, complaints and legal compliance.

2.6 Providing technology, check-in tools, newsletter space, entry data, reports, templates or administrative support does not make LocalLoop the promoter or operator of a store-run promotion.

2.7 Unless LocalLoop expressly states otherwise in writing, LocalLoop does not conduct, manage, verify, redraw, fulfil or take responsibility for store-run promotions.

3. Subscription and Communications

3.1 When you subscribe to LocalLoop™ or join a LocalLoop VIP list, you consent to receive LocalLoop communications.

3.2 These communications may include:

3.2.1 weekly community newsletters;

3.2.2 local community updates;

3.2.3 prize draw notices and winner announcements;

3.2.4 partner store messages;

3.2.5 sponsored or paid placements included within the newsletter;

3.2.6 LocalLoop VIP communications;

3.2.7 occasional announcements;

3.2.8 referral or promotion updates; and

3.2.9 other LocalLoop-related promotional messages.

3.3 LocalLoop communications may include commercial content.

3.4 LocalLoop will identify itself as the sender of commercial electronic messages and include contact details.

3.5 Every LocalLoop marketing email will include an unsubscribe link.

3.6 You may unsubscribe at any time.

3.7 If you unsubscribe, LocalLoop will process your unsubscribe request in accordance with the Spam Act 2003 (Cth).

3.8 LocalLoop may keep records of subscription consent, including when and how consent was provided, where reasonably available.

3.9 If you unsubscribe before the close of a monthly subscriber draw period, you will not receive an entry for that month’s LocalLoop Monthly Subscriber Draw.

3.10 If you unsubscribe before the close of a LocalLoop referral or bonus-entry promotion period, any entry connected to continued subscription may become invalid.

4. Advertising and Sponsored Content

4.1 LocalLoop newsletters may contain sponsored placements, paid advertisements, partner messages, community notices, promotional listings or paid local business features.

4.2 Advertisers and sponsors do not receive access to subscriber personal information unless the subscriber separately provides their information directly to that advertiser or sponsor.

4.3 Advertising is delivered within LocalLoop communications or LocalLoop-controlled promotional channels.

4.4 LocalLoop may reject, edit or remove advertising or sponsored content at its discretion.

4.5 LocalLoop may include sponsored content or partner messages from participating local businesses, provided those messages are consistent with LocalLoop’s editorial and commercial standards.

5. LocalLoop Monthly Subscriber Draw

5.1 LocalLoop may conduct a monthly subscriber prize draw.

5.2 This draw is called the LocalLoop Monthly Subscriber Draw.

5.3 Unless otherwise stated, the prize is one $100 Activ Visa Gift Card.

5.4 The prize value is AUD $100.

5.5 The LocalLoop Monthly Subscriber Draw is a game of chance.

5.6 Skill plays no part in determining the winner.

5.7 Entry is free.

5.8 No purchase is required to enter.

5.9 A purchase does not increase the chance of winning.

5.10 The LocalLoop Monthly Subscriber Draw is separate from any store-run, in-store, VIP check-in, loyalty, referral, customer or partner-store prize draw.

6. LocalLoop Monthly Subscriber Draw Eligibility

6.1 Entry is open to Australian residents aged 18 years and over who are subscribed to LocalLoop during the relevant monthly draw period.

6.2 To be eligible, subscribers must provide:

6.2.1 first name;

6.2.2 last name;

6.2.3 valid email address; and

6.2.4 date of birth.

6.3 The date of birth provided at opt-in must be accurate.

6.4 LocalLoop may require the provisional winner to verify their date of birth before the prize is awarded.

6.5 If reasonably required, LocalLoop may request evidence of identity, including a government-issued ID, to confirm the winner’s name, age and date of birth.

6.6 LocalLoop may exclude subscriber draw entries that are incomplete, duplicated, fraudulent, automated, submitted using false information, or otherwise not in accordance with these terms.

6.7 LocalLoop employees, contractors, immediate family members and anyone directly involved in conducting the LocalLoop Monthly Subscriber Draw are not eligible to win.

7. LocalLoop Monthly Subscriber Draw Entry Rule

7.1 Each eligible subscriber receives one standard entry for each LocalLoop Monthly Subscriber Draw in which they remain subscribed to LocalLoop.

7.2 To receive an entry, the subscriber must still be subscribed and meet all eligibility requirements at the close of the relevant monthly draw period.

7.3 If a person unsubscribes before the monthly draw period closes, they will not receive an entry for that month.

7.4 LocalLoop may offer bonus entries from time to time as part of a clearly identified promotion, campaign or subscriber incentive.

7.5 Where bonus entries are offered, LocalLoop will clearly state the number of bonus entries available, the eligibility requirements, and the applicable closing date and time in the relevant promotional material.

7.6 Bonus entries are additional to the subscriber’s standard monthly entry unless the relevant promotional material states otherwise.

7.7 Bonus entries apply only to the specific draw or promotion for which they are offered and do not carry forward to future draws.

7.8 LocalLoop may limit a bonus-entry promotion to eligible subscribers who complete one or more stated actions within the promotional period, including nominating a participating local business or store, selecting their local area, completing or updating their subscriber profile, or completing any other clearly stated promotional requirement.

7.9 Subscribers who join after the relevant monthly draw period closes will be entered into the next applicable monthly draw, provided they remain eligible.

8. LocalLoop Monthly Subscriber Draw Period

8.1 Unless LocalLoop states otherwise, each LocalLoop Monthly Subscriber Draw includes eligible subscribers who are subscribed and have completed the required eligibility information at the close of the relevant calendar month.

8.2 LocalLoop may set a different draw period, promotional entry period or bonus-entry period for a specific promotion, provided the applicable dates, closing time and eligibility requirements are clearly stated in the relevant promotional material.

8.3 Any bonus entries offered for a specific promotion will apply only to the draw identified in that promotional material.

9. How the LocalLoop Monthly Subscriber Winner Is Drawn

9.1 After the LocalLoop Monthly Subscriber Draw period closes, all eligible subscribers who remained subscribed at the close of that draw period are exported into a spreadsheet.

9.2 Each eligible subscriber receives one row and one entry for that monthly subscriber draw.

9.3 Each row is assigned a row number.

9.4 The winning row number is selected at random using random.org.

9.5 The person listed on the selected row is the provisional winner, subject to identity and eligibility verification.

9.6 LocalLoop may keep a record of the draw, including:

9.6.1 the spreadsheet of eligible entries;

9.6.2 selected row number;

9.6.3 draw date;

9.6.4 draw time;

9.6.5 random.org result;

9.6.6 screenshots or supporting draw records; and

9.6.7 winner verification and prize delivery records.

9.7 This random.org process applies to the LocalLoop Monthly Subscriber Draw only.

9.8 LocalLoop does not conduct the random.org draw for store-run, in-store, VIP check-in, loyalty, customer or partner-store prize draws.

10. LocalLoop Monthly Subscriber Winner Notification and Verification

10.1 The provisional winner will be contacted by direct email using the email address provided at opt-in.

10.2 The winner must respond within 7 days of notification.

10.3 To verify identity, the winner must correctly confirm the date of birth provided when they opted in.

10.4 LocalLoop may also use the subscriber’s email address, full name and unique subscriber ID to confirm the correct winner.

10.5 If requested, the provisional winner must provide reasonable proof of identity before the prize is awarded.

11. LocalLoop Monthly Subscriber Failure to Verify or Respond

11.1 If the provisional winner does not respond within 7 days, cannot correctly verify their date of birth, cannot provide reasonable proof of identity if requested, is found to be ineligible, has unsubscribed before the draw period closed, or has provided false or incomplete information, LocalLoop may redraw the prize.

11.2 A redraw will be conducted using the same random.org draw process.

11.3 LocalLoop may also redraw the prize if the winner declines the prize or cannot reasonably be contacted.

12. LocalLoop Monthly Subscriber Prize Conditions

12.1 The LocalLoop Monthly Subscriber Draw prize is one $100 Activ Visa Gift Card, unless LocalLoop states otherwise.

12.2 The prize is not transferable, exchangeable or redeemable for cash, except where required by law.

12.3 Gift card use is subject to the supplier’s terms and conditions, including activation, expiry, redemption limits, merchant acceptance and use restrictions.

12.4 LocalLoop is responsible for issuing the $100 Activ Visa Gift Card to the verified winner of the LocalLoop Monthly Subscriber Draw.

12.5 LocalLoop is not responsible for lost, stolen, expired, declined, misused or incorrectly redeemed gift cards after the prize has been issued.

12.6 Any enquiries about gift card activation, balance, expiry or redemption must be directed to the gift card supplier.

13. LocalLoop Monthly Subscriber Prize Delivery

13.1 Once the winner has been verified, LocalLoop will arrange delivery of the $100 Activ Visa Gift Card by email, collection, post or another reasonable method.

13.2 LocalLoop will aim to issue the prize within 28 days of the winner being verified.

13.3 LocalLoop is not responsible for delay caused by incorrect contact details, failure to respond, identity verification delays, supplier issues or circumstances beyond LocalLoop’s reasonable control.

14. Store-Run and In-Store Prize Draws

14.1 From time to time, participating stores may choose to run their own store-based promotions.

14.2 These may include:

14.2.1 in-store prize draws;

14.2.2 VIP check-in draws;

14.2.3 loyalty draws;

14.2.4 customer giveaways;

14.2.5 referral promotions;

14.2.6 shopping credit promotions;

14.2.7 voucher promotions;

14.2.8 club or community partner promotions; and

14.2.9 other store-based promotions.

14.3 Store-based promotions are separate from the LocalLoop Monthly Subscriber Draw.

14.4 Unless LocalLoop expressly states otherwise in writing, the participating store is the sole promoter and operator of any store-based promotion.

14.5 LocalLoop does not operate, conduct, manage, draw, verify, fulfil or take responsibility for store-based prize draws.

14.6 LocalLoop does not run random.org draws for store-based prize draws.

14.7 LocalLoop’s role may be limited to providing the LocalLoop platform, check-in technology, newsletter communication channel, promotional support, and access to check-in or entry data where applicable.

14.8 Providing technology, data, communications support, reports, check-in records or promotional support does not make LocalLoop the promoter or operator of the store-based promotion.

14.9 The participating store is solely responsible for ensuring its store-based promotion complies with all applicable laws.

15. Store Responsibility for Promotion Terms

15.1 The participating store is solely responsible for setting and publishing the terms of its own store-based promotion.

15.2 The store’s promotion terms should state, where applicable:

15.2.1 the participating location;

15.2.2 the promoter of the promotion;

15.2.3 the prize or prize type;

15.2.4 the prize value;

15.2.5 the promotional period;

15.2.6 the draw date or timing;

15.2.7 how to enter;

15.2.8 eligibility requirements;

15.2.9 entry limits;

15.2.10 winner notification process;

15.2.11 redraw process;

15.2.12 prize delivery method;

15.2.13 privacy details; and

15.2.14 any permits, approvals or legal disclosures required for the promotion.

15.3 LocalLoop may provide template wording or administrative guidance to participating stores, but the store remains responsible for the final promotion terms.

15.4 The store should obtain its own legal advice before running a promotion where required.

16. Store Responsibility for Eligibility and Entries

16.1 The participating store is solely responsible for determining eligibility for its own store-based promotion.

16.2 The participating store is solely responsible for deciding whether an entry is valid, invalid, duplicated, incomplete, fraudulent, late, manipulated or otherwise ineligible.

16.3 If LocalLoop provides check-in records, subscriber records, entry exports, timestamps, location data or other system information to the store, that information is provided for administrative support only.

16.4 The participating store remains solely responsible for reviewing and relying on that information for the purposes of its own promotion.

16.5 LocalLoop does not guarantee that any person is eligible to win a store-based prize.

16.6 LocalLoop does not accept responsibility for any error, omission, dispute or decision relating to eligibility for a store-based promotion.

17. Store Responsibility for Draws and Winner Selection

17.1 The participating store is solely responsible for conducting any draw connected to its own store-based promotion.

17.2 The participating store is solely responsible for selecting the winner.

17.3 The participating store is solely responsible for recording the draw process.

17.4 The participating store is solely responsible for retaining draw records.

17.5 The participating store is solely responsible for verifying the winner.

17.6 The participating store is solely responsible for conducting any redraw.

17.7 The participating store is solely responsible for resolving any dispute about the draw.

17.8 If LocalLoop provides an entry export, spreadsheet, check-in list or other data file to the store, the store remains solely responsible for conducting the draw and confirming the winner.

17.9 LocalLoop does not select, verify or confirm winners for store-based prize draws.

17.10 LocalLoop does not run the random.org draw for store-based prize draws.

17.11 If LocalLoop expressly agrees in writing to provide limited administrative support for a store-based draw, LocalLoop acts only as an administrative service provider, and the participating store remains the promoter and remains responsible for the promotion, prize and compliance.

18. Store Responsibility for Winner Notification and Verification

18.1 The participating store is solely responsible for contacting the winner of its own store-based promotion.

18.2 The participating store is solely responsible for verifying the winner’s identity, age, eligibility and entry details.

18.3 The participating store is solely responsible for deciding whether a winner has failed to verify, failed to respond, declined the prize, is ineligible, or should be replaced by redraw.

18.4 LocalLoop is not responsible for contacting, verifying, approving or rejecting winners of store-based promotions.

19. Store Responsibility for Prizes and Prize Delivery

19.1 The participating store is solely responsible for supplying, funding, issuing and delivering any prize offered in connection with its own store-based promotion.

19.2 The participating store is solely responsible for ensuring that the prize is lawful, accurately described, available, fit for purpose and delivered to the verified winner.

19.3 LocalLoop is not responsible for any store-based prize.

19.4 This includes any failure to supply, delay, substitution, loss, expiry, defect, misuse, refusal, complaint or dispute relating to the prize.

19.5 Any questions, complaints, claims or disputes about a store-based prize must be directed to the participating store.

19.6 LocalLoop is responsible only for prizes expressly offered by LocalLoop, including the LocalLoop Monthly Subscriber Draw $100 Activ Visa Gift Card.

20. Store Responsibility for Permits and Legal Compliance

20.1 The participating store is solely responsible for obtaining any permit, authority, approval, legal advice or compliance review required for its own store-based promotion.

20.2 The participating store is solely responsible for ensuring that its promotion complies with all applicable Commonwealth, state and territory laws.

20.3 The participating store is solely responsible for ensuring that its prize is lawful and not prohibited or restricted.

20.4 LocalLoop may refuse to promote, display, support or provide platform access for any store-based promotion that LocalLoop reasonably believes may be unlawful, misleading, unfair, incomplete, high risk, or inconsistent with LocalLoop’s standards.

20.5 LocalLoop may suspend or remove any store-based promotion from LocalLoop channels at its discretion.

21. Store-Based Promotion Liability

21.1 To the maximum extent permitted by law, LocalLoop is not liable for any loss, damage, delay, complaint, dispute, claim, cost or liability arising from or connected with a store-based promotion.

21.2 This includes issues relating to:

21.2.1 promotion terms;

21.2.2 eligibility;

21.2.3 entries;

21.2.4 draw process;

21.2.5 winner selection;

21.2.6 winner notification;

21.2.7 identity verification;

21.2.8 redraws;

21.2.9 prize supply;

21.2.10 prize delivery;

21.2.11 prize use;

21.2.12 permits or approvals;

21.2.13 privacy handling by the store;

21.2.14 consumer complaints; and

21.2.15 legal compliance.

21.3 Nothing in these terms excludes, restricts or modifies any rights, remedies, guarantees or protections that cannot be excluded under Australian Consumer Law or other applicable laws.

22. Referral and Bonus Entry Promotions

22.1 From time to time, LocalLoop or a participating store may offer referral or bonus-entry promotions.

22.2 Referral and bonus-entry promotions are not offered at all locations or at all times.

22.3 A referral or bonus-entry promotion only applies where it is specifically advertised by LocalLoop or a participating store.

22.4 Where no referral or bonus-entry promotion is advertised, no referral or bonus-entry benefit applies.

22.5 If LocalLoop offers the referral or bonus-entry promotion, LocalLoop will publish or make available the relevant promotion details.

22.6 If a participating store offers the referral or bonus-entry promotion, the store is solely responsible for the promotion, including the prize, entries, eligibility, draw, winner notification, verification, delivery and legal compliance.

23. LocalLoop Referral Entry Conditions

23.1 Where LocalLoop offers a referral promotion, participants may receive entries by referring new members to join the LocalLoop VIP Club or LocalLoop subscriber list.

23.2 A referral entry is earned only when the referred person successfully joins LocalLoop using the referral method provided by LocalLoop.

23.3 Unless otherwise stated in the promotion:

23.3.1 each successful referral earns one entry into the applicable LocalLoop draw; and

23.3.2 referral entries accumulate during the promotional period.

23.4 A referral will only qualify where the referred person:

23.4.1 successfully joins LocalLoop;

23.4.2 provides valid contact details;

23.4.3 is not already registered as a LocalLoop subscriber or VIP member;

23.4.4 confirms their subscription where required; and

23.4.5 remains subscribed at the time of the relevant draw, where stated in the promotion.

23.5 The referred person must be a genuine new LocalLoop member or subscriber.

23.6 By submitting a referral, the referrer confirms they have permission from the referred person to provide their contact details to LocalLoop for the purpose of inviting them to join LocalLoop.

24. Prohibited Referral Activity

24.1 To protect the fairness of LocalLoop referral promotions, the following will not qualify as valid referrals:

24.1.1 referring yourself using alternate contact details;

24.1.2 referring people without their permission;

24.1.3 automated, bulk or artificially generated referrals;

24.1.4 duplicate referrals of the same individual;

24.1.5 temporary, fake or disposable email addresses;

24.1.6 entries submitted using false information; and

24.1.7 any activity that LocalLoop reasonably considers fraudulent, manipulative or inconsistent with the purpose of the promotion.

24.2 LocalLoop reserves the right to invalidate any referral entries in a LocalLoop-run referral promotion that breach these conditions.

24.3 Only the first valid referral associated with a new subscriber will qualify for an entry, unless LocalLoop states otherwise.

24.4 Each unique email address may only generate one referral entry, regardless of how many times it is submitted.

24.5 LocalLoop may use automated systems and manual review to detect duplicate, temporary, automated, fraudulent or suspicious registrations.

24.6 LocalLoop may apply reasonable limits to the number of referral or bonus entries that may be earned by a single participant during a promotional period.

25. Vouchers, Rewards and Promotions

25.1 LocalLoop technology may be used by participating stores to issue or promote vouchers, rewards, coupons, credits or other local offers.

25.2 Unless expressly stated otherwise, vouchers, rewards, coupons and store offers are issued by the participating store, not LocalLoop.

25.3 Voucher conditions, including minimum spend, expiry, eligible categories and redemption limits, are specified by the participating store or on the voucher itself.

25.4 Vouchers, rewards, credits and promotional offers are not transferable, exchangeable or redeemable for cash, except where required by law.

25.5 Lost, stolen or expired vouchers may not be reissued or refunded, unless required by law.

25.6 Participating stores are solely responsible for honouring, refusing, verifying, redeeming or resolving disputes about their own vouchers, rewards, credits or promotional offers.

25.7 Customer enquiries, complaints, refunds or redemptions relating to purchases, vouchers, rewards or store offers must be directed to the participating store.

26. Winner Publication

26.1 For LocalLoop-run promotions, LocalLoop may publish a winner’s first name, suburb or town, prize details and participating location in LocalLoop emails, websites, social media, partner store materials or other promotional material.

26.2 LocalLoop will not publish a winner’s full date of birth, full email address, phone number, full residential address or government ID details.

26.3 By entering a LocalLoop-run draw, participants consent to reasonable winner announcement activity connected to the promotion.

26.4 For store-run promotions, winner publication is the responsibility of the participating store.

27. Location and Check-In Data

27.1 When a participant taps, scans or checks in using LocalLoop at a participating store, LocalLoop may request temporary location access to help verify that the participant is physically at or near the participating location.

27.2 Location access is used for check-in validation, fraud prevention and promotion integrity.

27.3 LocalLoop does not use check-ins for continuous live tracking.

27.4 If a participant denies location access, the check-in may not be accepted or may not qualify for a relevant promotion.

27.5 LocalLoop may record check-in time, participating store, device data, IP address, approximate location data and related technical information for security, fraud prevention, reporting and promotion administration.

28. Privacy and Data Collection

28.1 LocalLoop collects personal information for the purpose of operating LocalLoop services, communications, newsletters, VIP lists, check-ins, LocalLoop-run promotions, subscriber draws, referral programs, customer support, security, analytics and legal compliance.

28.2 Information collected may include:

28.2.1 first name;

28.2.2 last name;

28.2.3 email address;

28.2.4 mobile number;

28.2.5 date of birth;

28.2.6 town, suburb or location;

28.2.7 participating store or location;

28.2.8 subscription status;

28.2.9 unique subscriber ID;

28.2.10 unique entry ID;

28.2.11 check-in records;

28.2.12 referral records;

28.2.13 engagement data, including opens and clicks;

28.2.14 device type, browser, IP address, time stamp and technical data;

28.2.15 location verification data, where used for in-store check-ins; and

28.2.16 other information reasonably required to operate LocalLoop.

28.3 LocalLoop collects date of birth to confirm age eligibility, reduce fraud, verify winner identity and help ensure prizes are awarded to the correct person.

28.4 LocalLoop may collect limited technical data for security, fraud prevention, analytics and system performance.

28.5 LocalLoop does not sell or rent subscriber personal information.

28.6 LocalLoop may use trusted third-party service providers to store data, send emails, manage forms, process check-ins, run analytics, assist with prize fulfilment or operate LocalLoop systems.

28.7 These service providers may only use personal information for the services they provide to LocalLoop and must handle the information in accordance with applicable privacy and confidentiality obligations.

28.8 LocalLoop will take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

29. Use and Disclosure of Personal Information

29.1 LocalLoop may use personal information to:

29.1.1 send newsletters and communications;

29.1.2 operate LocalLoop VIP lists;

29.1.3 record in-store check-ins;

29.1.4 administer the LocalLoop Monthly Subscriber Draw;

29.1.5 verify LocalLoop-run promotion winners;

29.1.6 deliver LocalLoop-run promotion prizes;

29.1.7 detect duplicate, fraudulent or suspicious entries;

29.1.8 manage LocalLoop referral and bonus-entry promotions;

29.1.9 provide customer support;

29.1.10 report de-identified or aggregated performance data to participating stores;

29.1.11 improve LocalLoop services;

29.1.12 comply with legal obligations; and

29.1.13 send relevant promotional, partner or sponsored messages through LocalLoop channels.

29.2 LocalLoop may share limited information with a participating store where reasonably required to support that store’s own promotion, verify check-ins, provide entry exports, assist prize administration, provide de-identified or aggregated performance reporting, or operate LocalLoop services.

29.3 Where LocalLoop provides information to a participating store for a store-run promotion, the store is responsible for its own use of that information and must comply with applicable privacy laws.

29.4 LocalLoop will not give advertisers direct access to subscriber personal information unless the subscriber separately provides information directly to that advertiser.

29.5 LocalLoop may disclose personal information where required or authorised by law.

30. Service Providers and Overseas Storage

30.1 LocalLoop uses trusted third-party service providers to operate newsletters, forms, contact storage, email automation, check-ins, analytics and related services.

30.2 These providers may process limited personal information on LocalLoop’s behalf.

30.3 Current or future service providers may include:

30.3.1 Systeme.io, used for CRM, contact storage, forms, email automation and subscriber communications;

30.3.2 Google services, used for business administration, reporting, files or analytics where applicable;

30.3.3 automation, hosting, analytics, email delivery, payment, SMS, fraud prevention and operational support providers; and

30.3.4 other trusted technology providers used to operate LocalLoop.

30.4 Personal information may be stored in Australia or with trusted service providers located outside Australia.

30.5 This may include Systeme.io, operated by ITACWT Limited in Ireland, and related infrastructure hosted in Ireland or the European Union.

30.6 By subscribing to LocalLoop, joining a LocalLoop VIP list, checking in at a participating store, or entering a LocalLoop-run promotion, you acknowledge that your personal information may be stored or processed outside Australia for the purposes described in these terms.

30.7 LocalLoop will take reasonable steps to ensure overseas service providers handle personal information consistently with the Australian Privacy Principles.

30.8 LocalLoop does not sell or rent subscriber personal information.

31. International Privacy Rights

31.1 LocalLoop is an Australian service intended for Australian subscribers, LocalLoop partner stores and Australian local communities.

31.2 LocalLoop handles personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

31.3 Where privacy laws outside Australia apply to a specific person or situation, LocalLoop will take reasonable steps to respond to valid privacy requests in accordance with those laws.

31.4 LocalLoop does not actively target people in the European Union unless expressly stated otherwise.

31.5 Nothing in these terms limits any privacy rights that apply by law.

32. Access, Correction, Deletion, Security and Data Breaches

32.1 You may request access to personal information LocalLoop holds about you.

32.2 You may request correction of inaccurate personal information.

32.3 You may request deletion of your personal information, subject to any legal, compliance, fraud prevention, accounting, dispute-resolution or record-keeping requirements.

32.4 You may withdraw consent to receive LocalLoop marketing communications by unsubscribing.

32.5 LocalLoop will respond to privacy requests within a reasonable time and will aim to respond within 30 days.

32.8 LocalLoop takes reasonable technical and organisational measures to protect personal information.

32.9 LocalLoop may retain subscriber records, check-in records, consent records, unsubscribe records, fraud prevention records, draw records, winner records and prize fulfilment records for legal, compliance, audit and dispute-resolution purposes.

32.10 LocalLoop may retain unsubscribe records to ensure unsubscribe requests are honoured.

32.11 If LocalLoop becomes aware of a data breach that is likely to result in serious harm, LocalLoop will assess the breach and notify affected individuals and the Office of the Australian Information Commissioner where required by the Privacy Act 1988 (Cth).

33. Legal Compliance, Liability, Intellectual Property and Governing Law

33.1 LocalLoop-run promotions are intended to operate as free-entry trade promotions or promotional games.

33.2 LocalLoop will comply with applicable Commonwealth, state and territory laws for LocalLoop-run promotions, including where relevant:

33.2.1 Spam Act 2003 (Cth);

33.2.2 Privacy Act 1988 (Cth);

33.2.3 Australian Privacy Principles;

33.2.4 Australian Consumer Law;

33.2.5 applicable state and territory trade promotion, gaming and lottery laws;

33.2.6 NSW community gaming and trade promotion requirements;

33.2.7 Victorian trade promotion lottery requirements;

33.2.8 Queensland Category 4 promotional game requirements; and

33.2.9 any other laws that apply to a specific LocalLoop-run promotion.

33.3 Participating stores are responsible for complying with all applicable laws for store-run promotions.

33.4 If a LocalLoop-run promotion requires a permit, authority, licence, approval, additional disclosure, altered mechanics or additional terms under applicable law, LocalLoop may amend, suspend or delay the promotion until those requirements are satisfied.

33.5 If a store-run promotion requires a permit, authority, licence, approval, additional disclosure, altered mechanics or additional terms under applicable law, the participating store is responsible for satisfying those requirements.

33.6 This promotion framework is intended for low-value free-entry draws. If a prize pool increases, a promotion is expanded, paid entry is introduced, or draw mechanics change, the responsible promoter should review the applicable legal requirements before proceeding.

33.7 To the maximum extent permitted by law, LocalLoop is not responsible for any loss, damage, delay, technical failure, incorrect entry details, email delivery issue, mobile network issue, location verification issue, third-party supplier issue, gift card issue, partner store issue, or other problem that affects entry, notification, verification, prize delivery or prize use.

33.8 LocalLoop is responsible for the LocalLoop Monthly Subscriber Draw $100 Activ Visa Gift Card only to the extent set out in these terms.

33.9 Participating stores are solely responsible for their own store-run promotions.

33.10 Nothing in these terms excludes, restricts or modifies any rights, remedies, guarantees or protections that cannot be excluded under Australian Consumer Law or other applicable laws.

33.11 All intellectual property in LocalLoop™, LocalLink™, MarketLoop™ and SentryLoop™ brands and content is owned by Najah Pty Ltd. All rights reserved.

33.12 Participating stores grant Najah Pty Ltd a non-exclusive, royalty-free licence to use their trade name, logo and approved promotional material for LocalLoop program purposes.

33.13 Before commencing legal proceedings, the parties agree to attempt in good faith to resolve disputes through negotiation or mediation where appropriate.

33.14 These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction.

33.15 The current version of these terms will be made available through LocalLoop or participating LocalLoop channels.

33.16 Continued subscription, participation or use of LocalLoop after an update means you accept the updated terms.

34.6 If LocalLoop receives an enquiry about a store-run promotion, LocalLoop may direct the participant to the relevant participating store.
